Thom has litigated cases through trial and appeal over a dozen times for both plaintiffs and defendants which involved catastrophic injuries and death. These trials dealt with general negligence claims (such as car “accidents” or unsafe premises) and professional negligence (malpractice by a physician, hospital, clinic, nursing home, etc.) or elder abuse.

In addition to his successful trial results in general negligence and medical malpractice cases primarily in the first half of his 35 year career, Thom has also achieved success in the Court of Appeal in this  practice area as follows:

2012

Meoni v. Vleugels and Buccigross, D058306 – Successful writ on behalf of plaintiff reversing lower court decision of anti-SLAPP motion in malpractice case against two psychiatrists

2011

Woodhams v. Superior Court of San Diego, D049910 – Successful writ on behalf of plaintiff reversing lower court’s order allowing “medical” examination by a vocational rehabilitation expert in a medical malpractice case for a severe brachial plexus injury and chronic regional pain syndrome.

1990

Brown v. Superior Court 224 Cal.App.3d 989 – Successful appeal on behalf of defendant reversing lower court summary judgment ruling regarding the time limitations for amending the complaint to add a claim for punitive damages against a health care provider.
